English Abstract

All parliaments in the parliamentary systems have the function of parliamentary oversight of the executive branch, the main objective of establishing and confirming such control in the constitution is based on the assumption that the legislative authority represents the people and speaks on its behalf, therefore its political control is one of the most important functions it exercises, effective and continuous realization of its objectives and objectives.

The parliamentary oversight is a successful and effective means to be indispensable in activating the principle of flexible separation between the authorities, and support for democracy as the house of representatives is the protector of rights and freedoms and therefore a way to detect the constitutional and legal violation that result from the governments practice of its actions and actions, from the weak to the stronger and the strongest is to withdraw confidence from the government.

The Jordanian legislator affirmed in the constitution and the bylaws of the house of representatives and the senate that the national assembly monitored the activity of the executive authority, and specified certain means of this control, namely the question, questioning and suggestion by the desire and request of the general debate, petitions and complaints and the parliamentary investigation committees, control safety and procedures.

The research on the subject of parliamentary oversight of the ministry is work required a statement of the means of control and the obstacles of this control, which limit its impact and carry out its tasks in the best way possible.

The problem of the study lies in the lack of constitutional and legal regulation of the means of parliamentary control over the work of the executive branch in a detailed and precise manner, and therefore the ineffectiveness of using these means to influence the approach of the executive authority, the problem is also the multiplicity of the executive branch is branches and the power of the legislature to possess legal elements as well as its control over the sources of information, which necessitated in this study to take into account all the obstacles of parliamentary control in order to develop appropriate solutions to address them.

The researcher concluded his study with a number of results, the most important of which were the formal obstacles to parliamentary control, where it was noted that there are formal obstacles that prevent the ability of the members of parliament to carry out their supervisory role, most notably the low efficiency and merit of some members of parliament or lack of experience in the methods of control and procedures.

Among them are the substantive obstacles to parliamentary control, there have been significant obstacles to the ability of parliamentarians to exercise their supervisory role, the most prominent of these is that the Jordanian constitution has failed to explicitly state that the request for public debate and the proposal is a parliamentary inquiry.

The researcher recommended a set of recommendations, most notably the amendment of the Jordanian constitution to include a text to prevent the threat of dissolution of the house of representatives in the event of the use of means of parliamentary oversight by parliamentary oversight by parliament, as well as the provision of parliamentary commissions of inquiry and request the general debate and the proposal of the desire of the means of parliamentary oversight
