Abstract EN

This study investigates the issue of sample sale based on a letter written by Imam Aalim Mohammed ben Hamza Al-Aydani (died in 1122HJ).

This type of sale is controversial among jurisprudential doctrines: some scholars like Malikis and Hanbalis consider this type of sale prohibited, while some others like Hanafis consider it abhorred.

In fact, it brings some kind of controversy as to whether it means 'prohibited' or just 'abhorred'.

The difference of views in Hanifi doctrine is verified by Imam Aalim Mohammed ben Hamza Al-Aydani in this letter concluding that the 'abhorrence' implies 'prohibition'.

The study is divided into two parts the first of which deals with the author's life and his authorized letter.

The second part deals with his scientific investigation of the text including his comments on the text.

I also take an independent approach in investigating the document and describing it in a way that corresponds to the author's intention of authorizing it.
