English Abstract

This study deals with the provision of the criminal responsibility of individuals according to the Statue of the International Criminal Court and sets out the substantive rules governing their application before the international Criminal Court.

The limitation of crime and the punishment of perpetrators in an objective of the international community.

To individuals before the Intonation Criminal Court, without regard to their official capacity, leadership positions or immunities.

The problem of the study shows how the rules of international criminal responsibility of individuals in international law and the problems they raise in application are established.

This thesis concluded with a series of results, the most important of which was that the idea of criminal responsibility of individuals was a widely debated idea.

Proponents Ans opponents but ultimately were said to attribute criminal responsibility to individuals.

This has been confirmed by the Statue of the International Criminal Court.

This study recommended a set of recommendations to promote the idea of international criminal responsibility for individuals, the most important of which is that the Court extend its judication to include other crimes of high gravity, such as the crime of terrorism, which has invaded the world in new ways and methods The researcher divided this study into two chapters as follows : Chapter I deals with the international criminal responsibility of individuals in terms of the nature of the criminal responsibility of individuals and their concept and the position of Islamic law and then addresses the historical development of the discusses the bases and contraventions of internation criminal responsibility, referring to the principle of legality as a basis for the international criminal responsibility of individuals.

Chapter II spoke to the legal scope of the international criminal responsibility of individuals in accordance with the jurisdiction of the internation Criminal Court, referring to the substantive and personal rules and then the principle of complementarity, judicial cooperation and sanctions contained in the Statue of the International Criminal Court.
