Abstract EN

This paper addresses the exceptional cases where money cannot be given to those who must not take it from the point of view of jurisprudence and contemporary application.

Nowadays, people need to pay money to get their life affairs and works done.

In our culture, there are several types of such cases, but our good ancestors put strict conditions such as if “ something is forbidden, its price is forbidden, too” based on “what is forbidden to be taken is forbidden to be given”.

They, however, (exceptionally) allow some cases, but again under very strict conditions and restrictions.

This study aims to highlight these cases.

The researcher concludes that previous as well as contemporary scholars have made Fatwas which allow the giver to give, but the taker not to take money.

There are also other cases that will be discussed in the research.
