Abstract EN

The constitutional amendment of 2016 creates the independent High Authority to control elections in articles 193 and 194 in order to ensure fairness and transparency in all its phases, and detail its work mechanism and internal regulations in the organic law of the Number 16/11 , its internal regulation.

In order to carry out its tasks, the independent high authority must contain (410) members; half of them are judges and the second half are people who have independent competencies within civil society, in addition to a President from the national personalities appointed by the President of the Algerian republic, the independent high authority is provided by several privileges before, during and after the elections; Using several mechanisms as automatic intervention and receive notifications and notifications.

Despite the positives that accompanied the establishment of the independent High Electoral Commission, the first regulatory experience, the fourth legislative elections may 2017, showed several deficiencies concerning its weak guarantees of independence, in addition to its limited powers, it failed in publishing its final report.

Thus; we have to overcome and fix these deficiencies amending Organic Law 16/11, before local elections scheduled in November 2017.
