Abstract EN

This study deals with the notion of “disagreement” as a jurisprudential topic in the Shafi’i doctrine, taking the opinions of latecomers of Shafi’i scholars in different countries.

It aims to clarify the concept of “disagreement”, study its stages and reasons and exemplify such aspects.

The researcher employs the historical approach in tracing the phenomenon, as well as the inductive approach in eliciting some examples of the findings and results.

The research concludes with some results, the most important of which are: no distinction between the notions of “disagreement” and “difference”, development of the notion of latecomers and dubbing the notion of “earlycomers” to those who came after Shaikh Zakaria Ansari and so on.

The results also include the reasons of disagreement such as disagreement due to transferring from Rafi’i and Nawawi, disagreement transferring from Shafi’i and the diversity of books of Ibn Hajar.

Thus, the researcher recommends to bring out the reasons of disagreement for each book, separately from others and study each book thoroughly.
