Abstract EN

This study aims to investigate the reality of logic, its subject matter and themes.

It also aims to explore the reasons of elicitation of jurisprudence (Fiqh) foundations from logic, and the foundational topics elicited from it.

The significance of this research lies in the influence of logic on the jurisprudence foundations, concerning elicitation through teaching it in universities as an introduction to the foundations of jurisprudence.

The problem of this study consists in the reasons of elicitation from, and influence of, logic.

It adopts the tracking and inductive approach, through which the topics of the logical foundations were analyzed and the reasons of elicitation were examined.

The study is divided into two parts: i) concept of logic and its subject matter, and ii) elicitation of jurisprudence foundations from logic.

It also has three sub-parts: definition of elicitation, linguistically and functionally, reasons and aspects of elicitation and the foundational topics elicited from logic.

It concludes that logic is a legal instrument and has scientific rules, measuring the truth or falsity of the mental evidence.

Its subject matter is the conceptual and factual information that lead to the conceptual and factual unknown aspects.

Logic is an introduction to all sciences, as is manifested by the huge amount of mental evidence of logic in jurisprudence and its foundations, among other branches of knowledge.

The study recommends to pay much attention to the traditional and academic studies in this regard.

It also recommends to focus on studies tackling the relationship between logic and jurisprudence.
