Electronic transactions are basically a set of computer programs, but most online users may not realize that some programs today can operate with high autonomy and are far from user control.

In fact, the smart agent can conclude contracts and transactions for the benefit of the user.

In transactions and in future contracts, the agent has the ability to modify the data and information provided on the basis of gained experience, so that he can make a better decision and can conclude transactions and contracts that contain data different from the provided information, along with the possibility of teaching its user to do so.

Therefore, the study tries to answer the question on the extent to which the smart agent can enjoy the status and nature of the legal personality, and the extent to which the user is responsible for electronic transactions, by presenting the trends of jurisprudence and the position of various legislations.
