The UN Security Council on March 31 adopted the 2005 resolution 1593, which was to refer the Darfur situation to the International Criminal Court in The Hague, and will let the decision of the court to prosecute officials Sudanese the government, the army, and tribal killings, rape, displacement, and torture in Darfur since the year 2002, as the government of Sudan and all parties to the conflict in Darfur, demanding to cooperate fully and provide any necessary assistance to the Court.

This after the decision excluded the US citizens in the framework of the United Nations Mission in front of the judiciary.

It is the first time that the Security Council refer the case to the International Criminal Court to prosecute perpetrators of genocide, war crimes and human rights violations in Darfur, though Sudan is not a signatory to the Statute of the Court states, which had an impact on this country as a state is a party to the Court system .
