After the Industrial Revolution, it was found that the Napoleon Code is incapable of protecting victims from bodily injury caused by traffic accidents and accidents at work.
In these circumstances, the obligation of security emerged through French jurisprudence in 1911 after doctrinal differences, and later it was accepted by modern legislation.
However, it fell quickly victim of the extension of its field of application, since it became more often an obligation of means after being an obligation of result, from where the removal of its true initial role.
Then, there appeared a very strong doctrinal trend that called for separating it from the contractual field and attaching it to the tort domain, since compensation for bodily injury is the function of tort and not contractual liability.
Thus with the evolution of modern legislation - which has gone beyond the classic classification of liability - the obligation of security has appeared in the form of a general duty imposed by the force of law, as is the case in the law.
on consumer protection and the prevention of fraud.
Given the growing international interest in the integrity of the human body, it seems that the future is moving towards a transformation of the obligation of security into a right to security.

Après la révolution industrielle, on a constaté que le code Napoléon est incapable de protéger les victimes des dommages corporels causés par les accidents de la circulation et les accidents de travail.
Dans ces circonstances, l’obligation de sécurité a émergé grâce à la jurisprudence française en 1911 après des divergences doctrinales, et par la suite, elle a été admise par les législations modernes.
Toutefois, elle est tombée rapidement victime de l’extension de son domaine d’application, puisqu’elle est devenu le plus souvent une obligation de moyen après avoir été une obligation de résultat, d’où l’éloignement de son vrai rôle initial.
Ensuite, est apparu un très fort courant doctrinal qui a appelé à la séparer du domaine contractuel et la rattacher au domaine délictuel, car l’indemnisation des dommages corporels est la fonction de la responsabilité délictuelle et non pas la responsabilité contractuelle.
Ainsi avec l’évolution des législations modernes - qui ont dépassé la classification classique de la responsabilité - l’obligation de sécurité est apparue sous forme d’un devoir général imposé par la force de la loi, comme c’est le cas dans la loi relative à la protection du consommateur et à la répression des fraudes.
Compte tenu de l’intérêt international croissant pour l’intégrité du corps humain, il semble que l’avenir se dirige vers une transformation de l’obligation de sécurité en un droit à la sécurité.
