Muslims have laid the foundations of the administrative regulations concerning the treatment of open lands and their people from the very beginning of the appearance of the Islamic State in Medina, specifically the reign of the Caliphs.

The real estate was formed in general and the land in particular the most important types of property around which there was a long discussion between the Islamic scholars, in order to determine the status of its various types and to adjudicate.

One of the most important questions raised about the land in the Islamic West is: has the Maghreb opened up or forcibly repaired? Has the land ownership in Andalusia been subject to Islamic sharia law? What are the forms of agricultural property in the Islamic west during the middle age? What are the types of land ownership during this period? These are the most important questions posed by the problem of this subject : "The status of land and forms of agricultural property in the Islamic west." To understand the different aspects of this study, we have adopted the method of narrative and analysis of texts, and sometimes resorted to comparing texts together when needed.

In this context, the nature of the subject imposed upon us a plan in which we dealt with the following elements: the definition of property language, and then the property in the terminology of the Fuqaha (jurists), as we know the sections of the earth, and then moved to talk about its status in the Maghreb and Andalusia, In the Islamic West, in view of the manner in which they were acquired or the method of their use at that time.
