Abstract EN

In the face of a growing number of cases and the difficulties processing them (criminal justice crisis), modern criminal policy resorts to utilizing alternative mechanisms, such as mediation as a new model for criminal justice, in order to treat the different types of criminal behaviour and support it crime fighting policy.

On the other hand, this allows participating parties to contribute in resolving their conflicts amicably.

As a result, Algerian legislation, among many others, opted for this procedural mechanism, which helps support its new philosophy regarding crime –fighting, and confirming that its interest is limited to not only the idea of deterring, and repressing, the offender but, above all, compensating the victim, within the frame of legal standards, as well as rehabilitating the offender.
