English Abstract
Public shareholding companies face difficulties during their careers that lead to their failure forcing the owners to follow the most effective means to rescue them from this situation, with the least possible losses, without having to dismantle them.
In particular, the process of Liquidation often carries large losses to the companies, and eventually leads to their end and disappearance, this is different from the restructuring, which would lift the company out of its stalemate and help it continue its activities for the aims which it was founded for.
The study was designed to discuss the process of restructuring the public shareholding companies, in light of the failure of the valid Companies Law, in the West Bank, and the Palestinian National Authority's efforts to adopt a new regulatory legislation for companies.
This was done through the process and research on procedural and objective aspects of this process.
The study was divided into a preliminary chapter and two other chapters.
The introductory chapter dealt with the issue of restructuring by looking at the means of dissolving the board of directors, forming the management committee and preparing the restructuring plan.
The second chapter focused on research on the substantive aspects of restructuring through discussing the financial and legal means of restructuring.
The study reached a number of results, the most important are: The failure of the valid Jordanian Companies Law of 1964 in force in the West Bank to cover the provisions related to the process of restructuring public shareholding companies as an alternative legal system for
