The duration of public service delegation is one of the essential elements of the contract which placed at the top of the priorities of the contractors.
It plays a complex role of conciliation between conflicting interests, on the one hand, the interest of the delegate to protect the ownership of the public service.
And on the other hand the delegate’s concern to ensure the functioning of public service for a long time in order to release the greatest possible profitability.
If the executive decree no18-199 imposes the principle of periodicity of the delegation agreements requiring the limitation of their duration, which constitutes an absolute obligation is intended to outlaw the conclusion of agreements of unlimited duration.
The same text raises a lot of ambiguity as to the legal regime of this essential element of public service delegations, since the determination of this clause in this text is neither clear nor sufficient and can not constitute a complete database for all aspects of fixing the duration.

La durée des délégations de service public constitue l’un des éléments essentiels du contrat, et se place au premier rang des priorités des contractants.
Elle joue un rôle complexe de conciliation entre des intérêts contradictoires : d’une part, l’intérêt du délégant de protéger la propriété du service public.
Et d‘autre part le souci du délégataire d’assurer le fonctionnement du service public pour une longue durée afin de dégager la plus grande rentabilité possible.
Si le décret exécutif n° 18-199 impose le principe de périodicité des conventions de délégation en exigeant la limitation de leur durée, ce qui constitue une obligation absolue visant à proscrire la conclusion de conventions à durée indéterminée.
le même texte suscite beaucoup d’ambigüité quant au régime juridique de cet élément primordial des délégations de service public, car la détermination de cette clause dans ce texte n’est ni claire ni suffisante et ne peut constituer une base de données complètes pour cerner touts les aspects de la fixation de la durée
