But the execution of the latter canbe accompanied by somerisksthatresult in the injury of passengersbodilyharms, in order to ensure the rights of the passenger and obligate the free carrier to ensuresafetyis no longer the role of the latter isn'tlimited to the transportation of passengersonly, but has a new obligation to transporting the passenger in safety and unharmed, even if there if thereisn't a transport contact betweenthemaccording to the article 138of the Algerian civil code, whichassesses the responsibility on the basis of guardingthings, because of thatcannot free carrier deniedresponsibilityonly by proof foreign cause.
