If France is the native country of administrative law, Algeria has inherited it, this law is known by its jurisprudential character linked to the litigation activity of the French administrative judge, who contributed to the development of these major principles and concepts, the case radically different in Algeria, where its administrative law loses this jurisprudential character, it is a purely a legislative law, these judges have tended more towards the adoption of the technique of interpretation, and if this praetorian law still jurisprudential in France, it is undoubtedly a clearly written law in Algeria, historical, legal and also material reasons contribute to the weakness of administrative jurisprudence in our country.
