Abstract EN

The organization of public contracts dealing aims to submit the interests of the contracting parties to a certain number of formalities in order to ensure the rationalization of public expenditure, and to try to embody the principles of transparency, equality and freedom of action, and access to the public demand, arriving at the preservation of the principle of competition whose dedication reflects the basic rule of all the regulations of the public deals.

however, through the adapted procedures of the articles 13 to 25 of presidential decree15-247 related to the organization of public deals and the public service delegations, we noted a lack of legal regulation, which affected the efficiency and the entrenchment of competition in these proceedings, which stems from the will of the Algerian legislator to maintain the regular functioning of public utilities services and the provision of public utilities in various circumstances.
