The respect of the principles of governance in consensual transactions is one of the most important guarantees in the use of public funds and the success of the national strategy of prevention and fight against corruption.
However, the contracting authority may infringe the rules of competition and transparency when concluding consensual transactions, since it enjoys greater freedom of contract, which makes it manifestly illegitimate.

Le respect des principes de gouvernance dans les transactions consensuelles est l’une des garanties les plus importantes dans l’utilisation des fonds publics et du succès de la stratégie nationale de prévention et de lutte contre la corruption.
Cependant, le pouvoir adjudicateur peut enfreindre les règles de concurrence et de transparence lors de la conclusion d’opérations consensuelles, car il jouit d’une plus grande liberté contractuelle, qui le rend manifestement illégitime.
