This article comprises an introduction showing the real meaning of communal property, followed by the concept of both property and communism in the Islamic Fiqh and the Algerian Civil Code.

Subsequently, I ended up by defining “Communal Property” and elucidating the Islamic jurisprudential terms and legal standards for each of the following cases: 1) When the partner proceeds in managing their part in the Communal Property on their own 2) When the partner proceeds in managing a designated amount of the Communal Money 3) When the partner proceeds in managing all of the Communal Money 4) The ownership’s advantages over Communism in the Algerian Civil Code
