Arabic Abstract

هدفت هذه الدراسة إلى بيان مدى انطباق قواعد المسؤولية الجنائية التقليدية على الإشتراك الجرمي الإلكتروني، و ذلك من خلال دراسة مقارنة للتشريعين العراقي و الأردني، حيث تناولت الدراسة بيان ماهية الاشتراك الجرمي، و بيان نطاق المسؤولية الجزائية عن الاشتراك الجرمي في الجرائم الإلكترونية، و ذلك من حامل المنهج الوصفي و التحليلي.

و في نهاية الدراسة توصلت إلى أن هذه الجريمة تقع لو حاول أي شخص بمساعدة آخرين و نجح في الدخول لنظام أو شبكة من خلال تجاوز تلك الضوابط و تجاوز التصريح أو انتحال صفة أو كان دخوله لتلك المؤسسة على سبيل الزيارة دون السماح له باستخدام نظام معلومات فيها أو الوصول إلى شبكة معلوماتية أو نظام معلومات فيها، كما جمع المشرع الأردني جمع بين المشترك و المحرض في نص واحد و جعل عقوبتهما أقل من عقوية الفاعل الأصلي على الجريمة، كما أن المشرع العراقي لم يشير إلى جريمة الاشتراك الجرمي عبر الوسائل الالكترونية، حيث نعود إلى القواعد العامة لتكييف هذه الجريمة.

English Abstract

This study aimed to demonstrate the extent of the application of the rules of traditional criminal responsibility to electronic criminal participation, through a comparative study of Iraqi and Jordanian legislation, where the study addressed the statement of what criminal participation is, and the scope of criminal responsibility for criminal participation in electronic crimes, through a descriptive and analytical approach .

At the end of the study, I concluded that this crime occurred if anyone tried with the help of others and succeeded in entering a system or a network by overriding these controls and bypassing the permit or impersonating or attending that institution as a visit without allowing him to use an information system in it or access a network An informational or information system in it, just as the Jordanian legislator collected the subscriber and the instigator in one text and made their punishment less than the original actor's punishment for the crime, just as the Iraqi legislator did not refer to the crime of criminal participation through electronic means, so we return to the general rules for adapting this crime.
