Arabic Abstract
تناولت الدراسة موضوع في غاية الأهمية و هو المسؤولية الجزائية لجرائم الإرهاب المرتكبة عبر الوسائل الإلكترونية في التشريع الأردني، فهذا الموضوع في غاية ( الخطورة الإرهاب الإلكتروني ) نظرا لما يفرضه من تهديدات على الأمن الوطني للعديد من دول العالم و من بينها الأردن.
و قد هدفت الدراسة إلى تحقيق العديد من الأهداف أهمها توضيح ماهية الجرائم الإرهابية التي ترتكب عبر الوسائل الإلكترونية و علاقتها مع الإرهاب التقليدي، إضافة إلى بيان لوجه المسؤولية عن هذه الجرائم كما وردت في التشريعات العقابية الأردنية، و بناء على ذلك توصل الباحث إلى العديد من النتائج و التوصيات و التي يتمثل أهمها بما يلي : 1.
أن أركان جريمة الإرهاب الإلكتروني هي نفس أركان جريمة الإرهاب العادية مع تميزها من حيث الأداء الجريمة.
2.
أن جريمة الإرهاب الإلكتروني من الجرائم العمدية فلا يمكن تصور وقوع الجريمة بخطا إلا أنها قد تكون قصد عام أو قصد خاص.
يوصي الباحث باتخاذ إجراءات تشريعية تتماشى مع الجرائم الإلكترونية تأخذ بعين الاعتبار الطبيعة الخاصة لهذه الجرائم لاسيما في مجال الدليل و الإنبات و الاختصاص و إجراءات التعاون و قواعد الإجراءات الجنائية.
English Abstract
The study dealt with a very important topic which is the criminal responsibility for terrorist crimes committed through electronic means in the Jordanian legislation, this topic is very dangerous ( electronic terrorism ) due to the threats it poses to the national security of many countries of the world, including Jordan.
The study aimed to achieve many goals, the most important of which is to clarify what are the terrorist crimes committed through electronic means and their relationship with traditional terrorism, in addition to showing aspects of responsibility for these crimes as mentioned in the Jordanian penal legislation, and accordingly the researcher reached many results and recommendations that are the most important ones include the following : -1That the elements of the crime of electronic terrorism are the same as the pillars of the ordinary crime of terrorism, with their distinction in terms of the crime tool.
-2The crime of cyber terrorism is one of intentional crimes.
It is not possible to imagine the crime occurring in error, except that it may be a general intent or a private intent.
-3The researcher recommends taking legislative measures that are in line with cybercrime, taking into account the special nature of these crimes, especially in the field of evidence, evidence, jurisdiction, cooperation procedures and rules of criminal procedures.
