Abstract EN

The Jordanian legislator aims to protect the sacred and religious sites located on the territory of the Hashemite Kingdom of Jordan, all of that in view of the importance and prestigious of such places, and for the negative impact might arise if an attack takes place.

The protection of the legislator to these holly and religious places have been through the criminalization of some illegal acts that may fall on these places, among these wrongful acts: sabotage or destruction or desecration of holly and religious places, the attack on the cemetery or funeral ceremony or the sanctity of the dead or on a place where to keep the remains of the deceased.

And any access to the holly places while people inside practice their religious, and disturb or abuse them, such acts directed the legislator to impose criminal Punishment on the perpetrators of these crimes.

This study seeks to define the holly shrines and to determinate the legal basic of their protection and to point out the unlawful acts those touchs these holly shrines.

Then to clear aut whether the Jordanian penal legislator lawe succeeded in providing criminal protection to the holly shrines or we still need to amend the valid provision in a way to guarrantee legal solid protection.
