Abstract EN

The main objective of this research is to determine the applicable Lawto tort civil liability for infringement of trade secrets.

Calcifies howthe TRIPs Agreement as well as Jordanian legislation did not include rules of attribution of the law applicable to the civil liability for infringing trade secrets; where the general rules of civil law must be adapted, which leads to the statement that if the trade secret was infringed within the Kingdom, the Jordanian law is the applicable law tothe act of aggression, but if outside the Kingdom, the law of the state of the act is the law applicable regardless of any other consideration, which deprives the owner of the trade secret from providing civil protection to his trade secret in the case where the act of aggression occurs in a state that does not provide legal protection or protection of trade secrets with less than the legal protection provided by the Jordanian Legislation
