Abstract EN

This paper dealt with the topic of penal protection of effective technological arrangements in accordance with the Jordanian law of the author right protection and related rights.

It concluded that the Jordanian legislator did not decide the penal protection of effective technological arrangements to protect rights holders only, but decided a penal protection to the same effective technological arrangements, thus by criminalizing acts of cheating or circumvention, or obstruction, even though the digital works protected by such arrangements are not protected by the law, particularly the works of public ownership.

It also reached the development of the Jordanian legislator in his decision on the penal protection of effective technological arrangements on the provisions of the WIPO Treaties by criminalizing preparatory work aimed at committing crimes of cheating or circumvention, or obstruction.
