Abstract EN

The insured may conclude an insurance contract that does not cover the whole value of the insured thing, and this is known as the insufficient insurance.

If the value of the thing insured is higher than the sum insured, the insurance company may apply in this case what is known as the proportional reduction rule.

That is to say, when the amount of insurance is less than the real value of the thing insured, the insurance company may require the insured to cover a certain percentage of the losses in the case of partial losses as it is stipulated in the law or insurance policy.

Since the Jordanian law says nothing about this matter, this study aims to explore the legal recognition of the rule of the proportional reduction, and determine its lawfulness under the Jordanian legislation which leaves this issue to be governed by the agreement of the parties in the insurance policy
