Abstract EN

Resignation is considered as one of the reasons for the termination of the functional relationships between the public employee and the administration.

This study aims at identifying the meaning of resignation, indicating its types, the administration's authority of wether accepting, rejecting or postponing it and its implications.

This study concluded that, unlike the Jordanian legislator, the Bahraini and Egyptian legislators have enacted the implicit resignation.

Furthermore, the study concluded that the resignation is a legitimate right of the public employee guaranteed by the constitution and the law within certain regulations.

In return, the legislator gave the administration the discretionary authority to accept or postpone it without expressly recognizing its right of rejecting it as a kind of balance between the public interest, which is represented in the regular functioning of the public facility, and the private interest, which is represented in not obligating the public official to do something that he does not want to do.
