Abstract EN

This study handles the mandatory rules and their implementation by the national judge, that is treated within the provisions of the Jordanian private international law, this study also aims to define the mandatory rules as well as its criteria which distinguish them from the other rules of law.

In this study it has been shown that mandatory rules that have been adopted by the state for social, economic or political reasons, due to public interests, are an exception to the general rules and apply to all disputes within its objective and geographic scope, whether national or international level.

This study clearly showed that the national judge would apply the national mandatory rules directly without referring to the conflict of laws rule, because are superior than internal conflict of laws rule, and can determine how the national judge apply the foreign mandatory rule through conflict of laws rules.

Finally, this study concluded that the national judge must apply foreign mandatory rules directly without referring to national conflict of laws rules, due to their significance and undeniable link with the subject matter of the dispute.
