Abstract EN

This study deals with the authority of the administration in withdrawing the contract of public works in the view of the Jordanian legislation.

It deals with the concept of public works contract referred to by the Jordanian government works system.

In addition to the characteristics of that contract, and the purpose of which is to achieve public benefit, up to the concept of withdrawal of the project referred to in Article (84) of the Regulations of the law of the organization of tenders and auctions.

Also, the jurists differed on the basis of the authority of the administration in withdrawing the project.

Some of them responded to the public authority's consideration, some of which were to be considered as public interest in addition to the terms of withdrawal of work or project from the contractor, and the results that come up from the withdrawal of the project or work with the contractor contracting with the administration.

The problem of the research lies in the legal nature of the authority of the administration in withdrawing the contract of public works, they constitute either a penalty by the administration or an administrative act or an independent The researcher reached a number of conclusions and recommendations.

One of these is that the Jordanian legislator did not specify the controls and cases related to the withdrawal of the work or the project from the contractor.

But the most necessary recommendation is the Jordanian legislator should specify the limits controls and cases related to the withdrawal of work on project from the contractor clearly and specifically.
