The UN General Assembly and The human Right Council’s explicit recognition of the human Right to water in 2010 is a significant step.

Although the resolutions of the two bodies are not legally binding, they affirm that the right to water derives from the right to an adequate standard of living and relates to both the right to highest attainable standard of physical and menthal health and the right to life and human dignity.

Thus, the human rights instruments which guarantee this right either explicitly or implicitly may provide a legal basis of the right to water in international law.

In addition, the right to water is increasingly recognized in national constitutions and legislations.

As regards the implementation of the right to water, states are obliged to respect, to protect and to fulfill such right.

However, the full realization of this right faces today some challenges and obstacles.

To overcome these challenges, some solutions are proposed.
