تعارض الرفع و الوقف عند الإمام النووي : دراسة تطبيقية على كتابه المنهاج في شرح صحيح مسلم بن الحجاج

Abstract EN

This study examines the reasons of the conflict between Al-Hadith Al-Marfu (elevated: A narration from the Prophet) and Al-Hadith Al- Mauquf (stopped: A narration from a companion only) at the Imam Al-Nawawi’s Book Al-Minhaj In Sharh Sahih Muslim bin Hajjaj.

The study starts with the biography of the imam, and then the definition of the contradiction between the Elevated and the Stopped, and its ruling according to the scholars.

The study suggested that the weighting between the Elevation and Stopping shall be made according to evidences and weighing factors.

The study application included five of the ten Hadiths of the Imam Al-Nawawi, documenting the Elevated narration over the Stopped one as an increase of confidence.

Some of these were supported by evidences, some of which were not supported, and only documented as an increase of confidence.

Through the applied study, it became evident for the researchers that the documentation of Al-Nawawi for the Elevated narrations and its advancement over the Stopped is not only as they increase confidence, but because of evidences supporting that documentation and advancement even if they were not written by the Imam
