Arabic Abstract

لقد جاءت هذه الدراسة بقصد تسليط الضوء على الأهمية الاستراتيجية لمضيق هرمز و انعكاساتها على الأمن في منطقة الخليج العربي، حيث يعتبر المنفذ الوحيد لبعض دول الخليج العربي، يؤدي هذا المضيق إلى الدول الثماني المتمثلة بالمملكة العربية السعودية، الإمارات العربية المتحدة، قطر، الكويت، سلطنة عمان البحرين العراق إيران و للتعرف عن الآليات القانونية المتعلقة بالمضايق البحرية و معرفة حقوق و واجبات الدول المشرفة على المضيق في وقت السلم و الحرب، و تسليط الضوء على معضلة أمن امدادات الطاقة، و من أجل التوصل رؤية كاملة، فقد وصف الباحث المشكلة في مضيق هرمز بحكم أهميته الاستراتيجية و الإقليمية و لاسيما إيران تسعى من خلال توظيف المضيق كورقة رابحة لمصالحها، و تبين فرضية الدراسة أن ثمة علاقة ارتباطية بين السيطرة على مضيق هرمز و سعي بعض الدول الإقليمية لتحقيق النفوذ، و قد وظف الباحث ثلاث مناهج، المنهج التاريخي، المنهج القانوني، المنهج الوصفي التحليلي.

يخضع مضيق هرمز لاتفاقية قانون البحار عام 1982 و تكمن أهميته في الملاحة الدولية و اعتباره مضيفا دوليا يخضع لنظام المرور العابر الذي أقرته اتفاقية البحار، توصلت الدراسة إلى اثبات صحة هذه التوصيات الانية، على إيران أتباع سياسة الاعتدال و عدم التهديد بإغلاق المضيق و ذلك لخضوعه لنظام حرية الملاحة المنصوص عليها في اتفاقية البحار، يوصي الباحث ضرورة تنفيذ ما جاء بفكرة تأسيس منظومة أمنية مشتركة بين دول الخليج العربي نتيجة التحولات على الساحة الإقليمية و الدولية، يجب على الدول الشاطئية لمضيق هرمز الالتزام بأحكام قوانين اتفاقية البحار عام 1982 إيران و سلطنة عمان.

English Abstract

The aim of this study was to shed light on the strategic importance of Hormuz Strait and its implications on the security in the Arab gulf region, as it's considered the only outlet for some Arab Gulf countries, this strait leads to the eight Arab countries, and to get an acquainted with the legal mechanisms that related to the marine straits and to know the rights and duties of the countries which are supervising on the strait in times of peace and war.

In order to reach full knowledge, the researcher described the problem in the Strait of Hormuz by exploring the importance of its location that links the Arabian Gulf with the Gulf of Oman, the process of strait closing leads to the instability of the global oil markets, the hypothesis of our study showed that there are regional states that seek to have an influence and dominance over the strait, the researcher employed four methods for the thesis, represented by the historical approach, the legal approach, systems analysis and descriptive method.

In order to confirm the validity of the researcher’s conclusions it was found that the strait is submitted to the Convention of Sea Law and is considered the main outlet for some Gulf countries; in addition, it is considered an international strait.

The study also proves the validity of these recommendations, which stipulated that Iran should follow the policy of calm and moderation.

The researcher also recommends the necessity to employing the idea of establishing a joint security system between the Arab Gulf states..
