Arabic Abstract

تناولت هذه الدراسة، قانون ( القومية اليهودية )، و هدفت إلى التعرّف على هذا القانون، و عوامل إنتاجه، و تأثيره على واقع القضية الفلسطينية و مستقبلها.

و برزت أهميتها في تتبعها له بعد إقراره كقانون أساس نافذ.

و انطلقت من فرضية مفادها بأن قانون ( القومية اليهودية ) يعود بتأثير سلبي على واقع القضية الفلسطينية و مستقبلها، تحديدا فيما يتعلّق بحقوق الشعب الفلسطيني الوطنية المشروعة، كذلك مستقبل فلسطينيو عام 1948، و عملية التسوية.

و يعود أيضا بتأثير إيجابي يتمثل بإمكانية محاصرة ( دولة الاحتلال باختراقها لقواعد القانون الدولي الإنساني.

و لاختبار هذه الفرضية، اعتمدت الدارسة المنهج التاريخي و الوصفي التحليلي و القانوني و التحليلي النظمي و الإستشرافي )، فتوصلت إلى مجموعة استنتاجات أهمها أن قانون ( القومية اليهودية ) يشكل حلقة من حلقات السياسة الصهيونية المتواصلة للسيطرة على المنطقة العربية.

و جاء تتويجا لمجموعة القوانين العنصرية التي سنتها ( دولة الاحتلال ) لغاية تجسيد مفهوم ( يهودية الدولة ) و فرضها على أرض الواقع.

و أهم ما أوصت به الدراسة، إعادة ترتيب البيت الفلسطيني، بحيث يجتمع النضال الفلسطيني على رؤية واحدة و ينتظم مع عمقه العربي في مشروع قومي و حدوي.

فالتوحد في برنامج عمل عربي_ فلسطيني لمواجهة قانون ( القومية اليهودية )، يعد الخطوة الأهم للوقوف في وجه الخطر الوجودي القادم.

English Abstract

This study addressed the Law of (Jewish Nationalism), and aimed to identify this law, its production factors, and its impact on the reality of Palestinian issue and its future, as its importance has emerged by follow-up this law after approve it as a basic law in force.

It was based form hypothesis of the law of (Jewish Nationalism) have a negative impact on the reality of Palestinian issue and its future, specifically regarding to legitimate national rights of the Palestinian people, in addition to future of the Palestinians of 1948, and reconciliation process.

It also has a positive impact, which is the possibility of besieging the (Occupying Power) by violating the rules of international humanitarian law.

To examine this hypothesis, the approaches of historical, descriptive, analytical, legal, organizational, and prospective were used in this study, as the study found a set of findings, the most important are: The Law of (Jewish Nationalism) constitutes a circle of the ongoing Zionist policy to control the Arab region.

And become as a culmination of a set of racist laws that enacted by (occupying Power) in order to enshrine the concept of (Jewish state) to enforce it on the ground.

The most important recommendation of the study is the rearrangement of the Palestinian house, so that the Palestinian struggle meets one vision and organizes with its Arab depth in a national and unitary project.

As the unity in an Arab-Palestinian action program to confront the law (Jewish nationalism) is considered the most important step to stand in the face of the coming existential threat.
