Arabic Abstract

تناولت هذه الدراسة بيان المقصود بالرضا في العمليات التجميلية، توضيح اثر الرضا على مسؤولية الطبيب في العمليات التجميلية، و اخيرا تحديد اثأر المسؤولية المدنية للطبيب في العمليات التجميلية، و قد استخدم الباحث في دراسته المنهج الوصفي بالاستعانة بالمراجع و الادبيات السابقة.

و توصل الباحث الى العديد من النتائج من اهمها أن أصبحت جراحة التجميل اليوم من الضروريات التي تستجيب لحاجات البشر بعد أن كان الاتجاه في بادئ الأمر لتحريمها باعتبار أنها تنطوي على مساس بسلامة الجسم دون أن تستهدف علاج عضويا بالمريض.

ثم أخذت موقعها من العمل الطبي و أصبح لها نظامها و أصولها و تعاليمها و شاعت في جميع البلدان لتشمل جميع أنواع التشوهات الخلقية و المكتسبة فعن طريقها يمكن للجراح إصلاح ما أفسده الدهر من جمال يحاول التشبث يرمي بالبقاء ضد إرادة و حكم الطبيعة.

و كما اعترف الفقه و القضاء الحديث بالهدف العلاجي لجراحة التجميل إذ غالبا ما يكون هذا العلاج نفسيا و لا شك أن العلاقة وثيقة بين نفسية الإنسان و صحته، و لكن و رغم ذلك فمازال هذا النوع من الجراحة يثار بشأنه الكثير من الجدل حول شرعيتها، و تحديد مفهومها و تناسبها مع الأعمال العلاجية التي تعتبر سببا و مبررا لتدخل الطبيب و مباشرة المساس بجسم الإنسان.

كما أثير الجدل حول طبيعة التزام الطبيب الجراح.

English Abstract

The current study aimed to identify patient’s satisfaction in plastic operations, explain the impact of satisfaction on physician’s liability in plastic operations, and lastly to identify the impacts of physician’s civil liability in plastic operations.

In his study, the researcher used the descriptive approach along with using references and previous studies.

The researcher concluded many results, the most important of which is that plastic operation has become a necessity responding to people’s needs while there was a tendency to prohibit it at the beginning, since it affects the safety of the body not aiming to treat the patient from a physical disease.

Later on, plastic operation positioned itself as a medical act which has its own system, principals and instructions, spreading in all countries to include all types of congenital and acquired malformations through which a surgeon can fix a beauty that was corrupted.

In addition, jurists and modern justice have acknowledged the treatment aim of plastic surgery, as this type of treatment is always psychological and there is no doubt that the relationship is firm between human’s psychology and health.

However, this type of surgery is still controversial relating to its legality, identification of its concept and its suitability with treatment works which is considered a reason and justification for physician’s intervention and to make an effect on a human body.

The surgeon’s liability was also a controversy.

Yet, a plastic operation makes it imperative for a physician to abide by conditions stipulated in law and administrative decisions stipulated by Ministry of Health and Medical Association.
