Arabic Abstract

تعتبر الدوائر المتكاملة ركيزة من الركائز الأساسية في المجالات الصناعية و التكنولوجية في العالم، حيث تشكل هذه الإلكترونيات الصغيرة عنصرا أساسيا تغلغل في أدق الصناعات التي تستخدم بشكل دائم و يومي من قبل المجتمعات و الأفراد.

و قد حظيت هذه التصاميم بالإهتمام الكبير في الإتفاقيات الدولية و أهمها إتفاقية تريس و إتفاقية و اشنطن لحماية تصاميم الدوائر المتكاملة، كما أنها حظيت بالإهتمام في القوانين الوطنية الأمر الذي عزز أهميتها الإقتصادية في الأسواق العالمية.

و قد جاءت هذه الدراسة لتسليط الضوء على الحماية المطلوبة و الضرورية في القانون الأردني الصادر قانون حماية التصاميم للدوائر المتكاملة رقم (10) لسنة 2000، و نظامه نظام حماية التصاميم للدوائر المتكاملة رقم ( 93 ) لعام 2002 حيث تناولت هذه الدراسة مفهوم تصاميم الدوائر المتكاملة و عالجت الشروط الواجب توافرها من شروط موضوعية و شروط شكلية، و الآثار المترتبة على منح الحماية و الاستثناءات الواردة عليها.

كما تعمقت الدراسة في بيان نطاق الحماية الممنوحة لتصاميم الدوائر المتكاملة و وسائل الحماية المدنية.

و قد تبين من خلال هذه الدراسة توافق القانون الخاص لتصاميم الدوائر المتكاملة الأردني مع ما جاء بالإتفاقيات الدولية.

و تكللت هذه الدراسة بعدة نتائج من أهمها أن المسؤولية الناشئة من التعدي على التصميم المحمي مسؤولية تقصيرية وفق شروط خاصة نتيجة لاشتراط المشرع إثبات سوء النية لدى المعتدي، و خلصت الدراسة بمجموعه من التوصيات من أهمها حذف شرط سوء النية الصعوبة إثباته و ذلك لتعزيز مجال الابتكار في هذا المجال و السعي الى التسجيل لحمايتها من قبل المصمم.

English Abstract

Integrated circuits are considered one of the main pillars in the industrial and technological fields in the world, as these small electronics constitute an essential component of penetration into the most accurate industries that are used permanently and daily by societies and individuals.

These designs have received great attention in international agreements, the most important of which are the TRIPS Agreement and the Washington Convention for the Protection of Integrated Circuit Designs.

They have also received attention in national laws, which have enhanced their economic importance in global markets.

This study came to highlight the required and necessary protection in the Jordanian law issued by the "Integrated Designs Protection Circuits" Law No.

(10) for the year 2000, and its system "Design Protection System for Integrated Circuits" No.

(93) for the year 2002.

This study examined the concept of designs Integrated circuits, and addressed the conditions that must be met from objective and formal conditions, and the effects of granting protection and the exceptions contained therein.

The study also delved into the scope of protection afforded to integrated circuit designs and civil protection methods.

Through this study, it was found that the Jordanian law is compatible with what came with international agreements.

This study culminated in several findings, the most important of which is that the responsibility arising from the infringement of the protected design is a tort liability in accordance with special conditions as a result of the legislator’s requirement to prove bad faith to the aggressor, and the study concluded with a set of recommendations, the most important of which is the removal of a bad faith condition for the difficulty of proving it in order to enhance the field of innovation in this field and strive To register for protection by the designer.
