Arabic Abstract
يرجع سبب تناول هذه الدراسة لموضوع الأمر و مركزه القانوني في الاعتماد المستندي إلى عدة أسباب أولها الأهمية التي يحظى بها الاعتماد منذ نشأته و حتى بلوغ التجارة الدولية شوطا كبيرا من التطور.
و ثانيها ندرة الدراسات التي سلطت الضوء على طالب فتح الاعتماد بوصفه طرقا بالغ الأهمية تبدأ منه عملية الاعتماد و تنتهي إليه.
و ثالثها: شخ النصوص التشريعية الذي يستند إليها الأمر و يستقى منها أحكام التزاماته و مسؤولياته تجاه أطراف الاعتماد الأخرى.
لذلك قامت هذه الدراسة باستجلاء مفهوم الأمر وتحليل طبيعة العلاقة القانونية التي تجمعه بأطراف الاعتماد ؛ متناولة التزاماته تجاههم و أسس مسؤوليته و دواعي الارتكاز إليها.
كما توصلت هذه الدراسة لمجموعة من النتائج و التوصيات أبرزها ضرورة تعديل نصوص الأصول و الأعراف الموحدة للاعتمادات المستندية بما يضمن إجلاء الغموض الذي يكتنف علاقة الأمر بأطراف الاعتماد.
English Abstract
The reasons why we chose this topic for the study which is the applicant legal status in letter of credit are: Firstly, the importance of the documentary credits.
Secondly, the scarcity of studies that concentrates on the applicant as a very essential part of the letter of credit.
Thirdly, the weakness of legislation that the applicant depends on, and He derives the provisions and responsibilities through the parts from it.
That is why the study explained the definition of the applicant and analyzed the nature of the legal relationship between the persons of letter of credit.
Finally :This study has concluded a group of results and recommendations such as the importance of adjusting the provisions of the uniform customary for the letter of credit in a way that make the relationship between the applicant and the parties of letter of credit obvious.
