Arabic Abstract

تناولت هذه الدراسة موضوع مسؤولية القاضي المدنية في التشريع العراقي، بهدف بيان الجانب الموضوعي و الجانب الإجرائي لها، من خلال البحث في مفهومها و نطاقها و الكشف عن أحكامها، و بيان القواعد و الإجراءات التي تحكم و تنظم هذه المسؤولية، و بيان مدى مسؤولية الدولة في تحمل الأثر المترتب عليها بالاستعانة بالنصوص القانونية و تحليلها، و الاستفادة من تجارب التشريعات المقارنة، و الاطلاع على الآراء الفقهية التي تناولت الموضوع، للوصول إلى مواطن الاختلاف و القصور في التشريع العراقي، بهدف ايجاد نظام قانوني متكامل و فاعل و موحد لمسؤولية القاضي المدنية.

و لقد خرجت الدراسة بعدة نتائج لعل أهمها، هو أن المشرع العراقي رغم تنظيمه للمسؤولية المدنية للقاضي بنصوص خاصة، إلا أن هذه المسؤولية لا تسري على جميع القضات و إنما تختص بقضاة معيين كما أن المشرع العراقي لم ينص صراحة ولا ضمنا على مسؤولية الدولة عن أعمال القضاة، مما جعل القضاء في العراق يتجه إلى رفض تقرير الدولة عن أخطاء القضاة، كما أن الدراسة توصلت إلى توصيات عديدة و من أهمها ضرورة وضع نظام قانوني جديد لمسؤولية القاضي المدنية، يتلاءم مع ما تشهده هذه المسؤولية من تطور، و ما وصلت إليه الاتجاهات الحديثة في هذا المضمار.

English Abstract

This study examined the issue of judge's civil liability in Iraqi legislation with the aim of explaining the substantive and procedural aspects of it by researching its concept and scope to reveal its provisions and to clarify the extent of the state’s responsibility to bear the impact thereof.

This is done by examining and analyzing legal literature, building on the experiences of comparative legislation and access to jurisprudence opinions that dealt with the topic to reach the differences and shortcomings in the Iraqi legislation with the aim of creating an integrated, effective and unified legal system for judge's civil liability.

Several results emerged from the study, perhaps the most important of which is that the Iraqi legislator, despite organizing civil liability of the judge in special provisions, however, this responsibility does not apply to all judges, but rather is concerned with specific judges.

Also, the Iraqi legislator did not explicitly or implicitly on the responsibility of the state for the actions of the judges which made the judiciary in Iraq tend to reject the state’s report on the erring of the judges.

The study also made several recommendations among the most important of these is the necessity of a new legislation system of judge's civil liability which is compatible with the development of this responsibility and the progress of modern trends in this field.
