Arabic Abstract

تعد مسألة استرداد الممتلكات من المسائل في غاية الأهمية في القانون الدولي، وذلك لما تشكله الممتلكات سواء عامة أو خاصة من أهمية بالغة و هامة للحفاظ على تاريخ الشعوب و الحياة الإنسانية حيث انه يعبر عن الحضارة الإنسانية و ماضي الإنسان فمثلا التراث الثقافي يدل على حضارة الإنسان و تقدمه ما بين الماضي و الحاضر.

و قد نتج عن الحروب و النزاعات المسلحة سواء دولية أو غير دولية اضرار بالغة في الممتلكات العامة و الخاصة من خلال التدمير و عمليات النهب و السرقة و قد تنبه المجتمع الدولي إلى مسألة في غاية بالأهمية و هي خروج الممتلكات المنهوبة و المأخوذة بالقوة أو الاكراه إلى خارج اقليمها و التجارة بها و هذا يعد من المخالفات الجسيمة للقانون الدولي حيث تحتاج هذه المخالفات إلى جهد دولي كبير لضبطها مما اضطر المجتمع الدولي و بالذات و بفترة ما بين الحرب العالمية الأولى و الى ما بعد الحرب العالمية الثانية.

إلى وضع نصوص و قواعد لضبط الية الاسترداد للممتلكات المنهوبة و المسلوبة من الشعوب و قد جعل المجتمع الدولي هذا الحق من حق الدول عامة، و جاءت عدة اتفاقيات دولية لتنسق هذا الحق و من هذه الاتفاقيات اتفاقية لاهاي لعام 1907 و اتفاقيات جنيف الاربع لعام 1949 و نصت الاتفاقيات الدولية التي تعنى بحماية و استرداد الممتلكات الثقافية منها اتفاقية لاهاي الحماية الممتلكات الثقافية في النزاعات المسلحة لعام 1954 و اعلان الحلفاء الصادر 5 يناير سنة 1943 فبحثنا مفهوم الحرب و النزاعات المسلحة و الحماية الدولية على الممتلكات وقت الحرب و بحثنا في حق الاسترداد و الاساس القانوني له و الية الاسترداد و عدة مباحث أخرى.

English Abstract

The issue of property recovery is of transcendental importance for international law, and that is because what constitutes property, whether public, private or cultural, is extremely important and important for preserving the history of peoples and human life, as it reflects human civilization and the human past.

For example, cultural heritage indicates Human civilization and its progress between past and present.

Also, wars and conflicts in international or non-international wars have resulted in serious damage to public, private and cultural property through destruction, looting and theft, and it may alert the international community to a matter of the utmost importance and is the exit of looted property taken by force or Coercion out of its territory and trade in it, and this is one of the grave breaches of international law, where these violations need a major international effort to control them, which compelled the international community, in particular between the First and Second World War.

To set the stipulations and rules for controlling the recovery mechanism for looted and stolen property from peoples, and the international community has made this right the right of states in general, and several international agreements have come to coordinate this right An example of these agreement is, the Hague convention in 1907 and the four Geneva Conventions in 1949 and The international agreements concerned with the protection and recovery of cultural property stipulated the Hague Agreement of the year for the protection of cultural property in armed conflicts of 1954 and the Allies Declaration issued on January 5, 1943, we discussed the concept of war and armed conflict, the international protection of property in time of war and we discussed the right of recovery and the basis The law has a recovery mandate and the other several investigations.
