Arabic Abstract

تتمحور مشكلة هذه الدراسة حول بيان الأحكام الموضوعية و الإجرائية للمسؤولية الجزائية عن جريمة التهديد عبر الوسائل الإلكترونية في كل من القانونين الأردني و العراقي؟؟.

وما هي سياسة المشرع الأردني و العراقي الجزائي في حماية الأشخاص من جرائم التهديد الإلكتروني ؟؟.

فتبين من خلال الدراسة أن المشرع الجنائي الأردني أدرك مدى خطورة جريمة التهديد بعد إنتشارها السريع بعد التقدم الهائل في وسائل التكنولوجيا الحديثة و أصدر لذلك قانون 27 لسنة 2015 الخاص بالجرائم الإلكترونية و شمل فيه جريمة التهديد الإلكتروني، و تبين كذلك أن المشرع العراقي لم يخطو حتى الآن خطوات نحو إصدار قانون خاص للجرائم المعلوماتية أو الرقمية على عكس الحال للمشرع الأردني، كما تم قبول الدليل الرقمي في مجال الإثبات أمام المحاكم الجنائية، و ذلك لما يمثله من قيمة ثبوتية في مجال جرائم تقنية المعلومات.

و انتهت الدراسة إلى جملة من التوصيات منها ضرورة أن يصدر المشرع العراقي قانون الجرائم الإلكترونية و أن يتضمن تجريم جريمة التهديد الإلكتروني، مع ضرورة أن يمتلك القاضي خلفية عن الوسائل التقنية و الإنترنت من أجل النظر في الدعاوى المعروضة أمامه في هذا الشأن و ذلك بإعداد الدورات له مع تطور البرامج التدريبية التي تهدف إلى تنمية قدرات العاملين في مجال مكافحة جرائم الإتصالات و المعلومات إذا أن التهديد يمارس من خلاله.

English Abstract

The problem of this study revolves around clarifying what are the objective and procedural provisions of criminal responsibility for the crime of threat via electronic means in both Jordanian and Iraqi laws ??.

What is the policy of the Jordanian and Iraqi criminal legislator in protecting people from cyber threat crimes ??.

It was found through the study that the Jordanian criminal legislator realized the seriousness of the threat crime after its rapid spread after the tremendous progress that occurred in modern technology and issued a law for the year 27 of 2015 related to electronic crime and included the crime of electronic threat, and it was also found that the Iraqi legislator has not yet taken steps Towards the issuance of a special law for information or digital crimes, unlike the case for the Jordanian legislator, and the digital evidence in the field of evidence has been accepted before the criminal courts, due to the evidence it represents in the field of information technology crimes.

The study ended with a number of recommendations, including the need for the Iraqi legislator to issue the electronic crime law and to include criminalization of the crime of electronic threat, with the need for the judge to have a background on technical means and the Internet in order to consider the cases before him in this regard by preparing courses for him, with the development of programs Training that aims to develop the capabilities of workers in the field of fighting communications and information crimes if the threat is exercised through it.
