Arabic Abstract

خلصت هذه الدراسة إلى تحديد مضمون ركن الشكل و الإجراءات في القرار الإداري من خلال توضيح أهم المعايير التي قيل بها فقها و قضاء للتمييز بين الأشكال و الإجراءات الجوهرية و غير الجوهرية و مدى تأثيرها على اعتبار القرار الإداري صحيحا ومنتجا لآثاره، كما خلصت هذه الدراسة إلى تباين طريقة انتهاء القرار الإداري من خلال الطريق غير العادي و هو طريق السحب و ذلك لتحديد انواع القرارات الإدارية التي يمكن سحبها و مدى مشروعيتها من عدمه و كان التركيز على قواعد الشكل و الإجراءات التي يجب على جهة السحب مراعاتها و التقيد بها سواء أكان مصدرها المشرع و القضاء و كذلك مدى نطاق سريان قواعد السحب و الية السحب كوسيلة لإنهاء القرار الإداري و ختمت الدراسة بالعديد من النتائج كان أهمها انسجام الموقفين الأردني و المصري باتباع هذه القواعد أضافه إلى العديد من التوصيات كان أهمها عدم التوسع في سحب القرارات الإدارية المشروعة على النطاقين الفردي و التنظيمي لأسباب تتعلق بالمراكز القانونية و استقرار المعاملات و حماية الحقوق المكتسبة.

English Abstract

This study concluded to determine the content of the corner of form and procedures in the administrative decision by clarifying the most important criteria by which it was said and spent to distinguish between forms and essential and non-essential procedures and the extent of their impact on considering the administrative decision correct and productive for its effects.

Through the extraordinary road, which is the road of withdrawal, in order to determine the types of administrative decisions that can be withdrawn and the extent of their legitimacy or not.

The focus was on the rules of form and procedures that the withdrawal party must observe and adhere to, whether it is the legislator’s source and the judiciary, as well as the extent of the validity of the rules of withdrawal and the mechanism of withdrawal as a means to end the administrative decision The study concluded with many results, the most important of which was the harmony of the Jordanian and Egyptian positions by following these rules, in addition to many recommendations, the most important of which was the failure to expand the withdrawal of legitimate administrative decisions on the individual and organizational levels for reasons related to legal centers, stability of transactions and the protection of acquired rights
