Arabic Abstract

تعد جرائم الفساد من الجرائم الخطيرة التي تلقي بظلالها على جميع مناحي الحياة في البلدان التي تعصف بها تلك الظاهرة، و تحتل مسالة مكافحة هذه الجرائم اهتماما متزايدا على الصعيدين الدولي و الداخلي.

و على الصعيد الوطني يحتل الادعاء العام بوصفه الممثل للهيئة الاجتماعية دورا بارزا في مكافحة هذا الجرائم.

و يتولى أعضاء الإدعاء العام في العراق مراقبة التحريات عن تلك الجرائم و إقامة الدعوى بالحق العام و متابعتها و الحضور عند اجراء التحقيق الابتدائي و في جلسات المحاكم الجزائية و تقديم الطعون و الطلبات و مراجعة طرق الطعن في القرارات و الأحكام الصادرة في تلك الدعاوى، و التحقيق في جرائم الفساد المالي والاداري.

بينما تتولى النيابة العامة في الأردن القيام بأعمال التحري عن جرائم الفساد و تعقب مرتكبيها و التصرف بأوراق التحقيق الأولي بنتيجة تلك التحريات، و إقامة الدعوى بالحق العام و مباشرتها في مرحلة التحقيق الإبتدائي.

فضلا عن متابعة تلك الدعوى لاحقا في مراحل المحاكمة و الطعن و تنفيذ الأحكام.

و قد تناول الباحث تلك المهام في ثلاث فصول توزعت على تلك المراحل و خلص بنتيجة ذلك إلى جملة من النتائج أهمها تباين موقف كل من المشرعين العراقي و الأردني من هذا الدور، ذلك أن الإدعاء العام في العراق يعد جهة اتهام لا تتولى التحقيق الإبتدائي إلا استثناء في حالتين محددتين على سبيل الحصر، هما غياب قاضي التحقيق في مكان الحادث، و التحقيق في جرائم الفساد المالي و الإداري بقيود محددة.

أما الثيابة العامة في الأردن فهي تتمتع بدور أكثر ايجابية في مجال مكافحة جرائم الفساد فهي تجمع بين مهام التحقيق الأولي و الاتهام و القيام بمهام التحقيق الابتدائي.

كما قدم الباحث بنتيجة الدراسة العديد من التوصيات التي يؤمل الأخذ بها.

English Abstract

Corruption crimes are among the serious crimes that cast a shadow over all aspects of life in Countries where this phenomenon exists ،the issue of combating these crimes occupies a growing concern both internationally and internally ،At the national level, the Public Prosecution, as the representative of the social organization, plays a prominent role in combating these crimes.

The members of the Public Prosecution in Iraq shall monitor the detectives of these crimes, Establishing the case for the public right and following it up, attend at the time of the initial investigation and in the hearings of the criminal courts and Submit appeals and requests, review methods of challenging decisions and judgments issued in those cases, and investigate financial and administrative corruption crimes While the Public Prosecution Office in Jordan undertakes investigating corruption crimes, tracking the perpetrators, Deal of the preliminary investigation papers as a result of these investigations ،and filing of the case the public right and initiate it in the initial investigation stage.

In addition to following up on this case later during the trial, appeal and execution of the sentences.

The researcher examined those tasks in three chapters distributed over those stages and concluded with the result of that to a set of results, the most important of which is the variation of the position of both Iraqi and Jordanian legislators on this role, because the public prosecution in Iraq is an accusation body that does not undertake the primary investigation except in two specific cases.

The exclusivity is the absence of an investigative judge at the scene of the accident, and the investigation of financial and administrative corruption with specific restrictions.

As for the public prosecution office in Jordan, it has a more positive role in combating corruption crimes, as it combines the tasks of the preliminary investigation, the accusation and the performance of the primary investigation tasks.

The researcher also presented the results of the study with many recommendations that it is hoped to be take.
