Arabic Abstract

تناولت في هذه الدراسة مسألة اليات توطين المعاهدات الدولية في القانون الوطني من خلال المقارنة بين التشريع الاردني و التشريع العراقي، حيث تكمن مشكلة الدراسة في التعارض الذي قد يحصل بين القوانين الوطنية و المعاهدات الدولية التي تلتزم بها الدول.

و تم بيان العلاقة بين القانون الدولي و القانون الداخلي من خلال النظريات التي جاء بها فقهاء القانون الدولي و هما نظرية ثنائية القانونين و نظرية وحدة القانونين، و قد رجح الفقه و القضاء الدوليان نظرية ثنائية القانونين كما رجحوا سمو القانون الدولي على القانون الداخلي.

ان اليات توطين المعاهدات الدولية تختلف باختلاف الدساتير، حيث ان الدستور الذي يتبنى نظرية وحدة القانونين لا يكون هناك تعارض بين المعاهدات الدولية و القانون الوطني، اما الدستور الذي يأخذ بنظرية ثنائية القانونين فقد يحدث تعارض بينهما لذلك قد يلجا القاضي الى محاولة الموائمة بين النصوص المتعارضة للقانونين أو قد يلجا التشريع الى نظام الاحالة او الاستقبال .

و قد خلصت الدراسة الى ضرورة اتخاذ خطوات استباقية في دساتير الدول التي قد تتعارض فيها احكام المعاهدات مع القانون الوطني و بالأخص في الاردن بان يحذو حذو التشريع العراقي الذي حل هذا التعارض بتشريع قانون المعاهدات .

English Abstract

The study, the tackles mechanisms of localization international treaties into national law was examined through a comparison between Jordanian and Iraqi legislation, where the problem of the study lies in the inconsistency that may occur between national laws and international treaties to which the states are bound.

The relationship between international law and national law is explained by the theories mentioned by the jurists of international law, which are the theory of Dualism and the theory of the unity of the two laws, international jurisprudence and the judiciary have suggested the theory of two laws as they suggested international law has superiority over domestic law.

The mechanisms for nationalizing international treaties differ according to the constitutions, as the constitution that adopts the theory of the unity of the two laws does not have a conflict between the international treaties and the national law.

On the other hand, the constitution that adopt the theory of the two laws a conflict may occur between them, so the judge may tries to reconcile between the two conflicted laws, or the legislation may resort to the system of reference or reception.

The study concluded that the need to take proactive steps in the constitutions of countries in which the rules of treaties may conflict with national law, particularly in Jordan, to follow the example of Iraqi legislation that solved this conflict through legislate a law of treaties.
