Arabic Abstract

تعد مسألة النزوح من المسائل المهمة التي تستوقف اهتمام المجتمع الدولي و ذلك لخطورة النتائج المترتبة عليها، خاصة بعد التزايد الكبير لأعداد النازحين فبتزايد أسباب النزوح ازدادت الانتهاكات الخطيرة لحقوق الإنسان و لعل السبب الأكثر شيوعا في حدوث عمليات النزوح هو النزاعات المسلحة بنوعيها الدولية و غير الدولية لما يحدث فيها من خروقات لقواعد القانون الدولي الإنساني، فتطرقنا في هذه الدراسة إلى الأسباب التي تدفع الإنسان إلى النزوح و قمنا بتحديد المركز القانوني للنازح من خلال بيان الحقوق التي حرصت المواثيق الدولية على تمتع النازح الداخلي بها كحقه في المساواة و عدم التمييز و حقه في الحرية و الأمن الشخصي و تمتعه بمستوى معيشي لائق، مؤشرين إلى دور الاتفاقيات الدولية في حظر النزوح الداخلي من خلال وضع قواعد و ضوابط الحماية السكان من التشريد الداخلي سواء وردت هذه القواعد في القانون الدولي لحقوق الإنسان أو القانون الدولي الإنساني بصفة هؤلاء السكان النازحين أشخاص مدنيين كما عملنا على بيان الأساس القانوني لجريمة التهجير القسري في كونها تعد هذه الجريمة من أبشع الانتهاكات لحقوق الإنسان و حرياته الأساسية، و خلصت الدراسة على توضيح الآليات القانونية و دور المنظمات الدولية لحماية السكان النازحين على الصعيد الإقليمي و العالمي من خلال المساعدات التي توفرها هذه المنظمات للنازحين و المهجرين.

English Abstract

The issue of displacement is one of the important issues that attract the attention of the international community due to the seriousness of its consequences, especially after the large increase in the number of displaced people.

With the increase in the causes of displacement, serious violations of human rights have increased, and perhaps the most common cause of displacement is armed conflict of both international and noninternational nature because of the violations of the rules of international humanitarian law.

In this study, we discussed the reasons that lead a person to be displaced, and we have determined the legal position of the displaced person by clarifying the rights that international conventions provide for the internally displaced to enjoy, such as his right to equality and non-discrimination, his right to freedom and personal security, and his enjoyment of an adequate standard of living.

We have clarified the role of international agreements in prohibiting internal displacement by establishing rules and regulations to protect the population from internal displacement, whether these rules are contained in international human rights law or international humanitarian law because these displaced populations are civilians.We have also clarified the legal basis for the crime of forced displacement, as it is one of the most brutal violations of human rights and fundamental freedoms.

The study concluded to clarify the legal mechanisms and the role of international organizations in protecting the displaced population at the regional and global levels through the assistance provided by these organizations to the displaced persons.
