Arabic Abstract

هدفت الدراسة لبيان الطرق القضائية لتسوية النزاعات الدولية، و الوقوف على مضامينها و ابعادها و دورها في تسوية المنازعات النزاعات الدولية و قد تم عرض موضوع الدراسة من خلال تقسيمها الى الفصول التالية : الفصل الأول خليفة الدراسة و أهميتها و الفصل الثاني المنازعات الدولية في ضوء القانون الدولي أما الفصل الثالث فعرض الطرق القضائية و أخيرا عرض الفصل الرابع تطبيقات عملية للطرق القضائية لتسوية النزاعات الدولية.

حيث بينت الدراسة أن الوسائل القضائية تختلف عن الوسائل السياسية لتسوية المنازعات الدولية من جهة أن تسوية النزاع في الوسائل القضائية يتم من قبل محكمة تفصل فيه طبقا الأحكام القانون الدولي، بينما يتم تسوية النزاع في الوسائل السياسية طبقا لإرادة الدول المتنازعة، و بحسب قدرة و موقف كل طرف في النزاع و المنازعات التي تصلح للتسوية القضائية هي المنازعات التي تتعلق بالمسائل القانونية، أما المنازعات السياسية فإنها لا تصلح للتسوية القضائية، و تسوية المنازعات بالوسائل القضائية إما أن تتم من قبل هيئة تختارها الأطراف المتنازعة يطلق عليها بالتحكيم أو من قبل هيئة متخصصة للنظر في المنازعات الدولية، تتفق الدول على انشائها و منها محكمة العدل الدولية و المحاكم الاقليمية، و بينت الدراسة أن محكمة العدل الدولية من الأجهزة الرئيسية في الأمم المتحدة، في ضوء نتائج الدراسة فإن أهم توصية ضرورة قيام جميع الدول بتسوية نزاعاتها بطرق سلمية مع الدول الأخرى، و الالتزام بعدم اللجوء الى القوة او التهديد أو استعمال القوة في علاقاتهم الدولية.

English Abstract

The study aims to show the judicial methods for settling international disputes, and to determine its contents, dimensions and role in settling international disputes.

The study was divided into the following chapters: Chapter one the background of the study and its importance, chapter two International disputes in light of international law, chapter three judicial methods and chapter four practical applications of judicial methods for settling international disputes.

The study shows that judicial means differ from political means in settling international disputes, On the one hand, the settlement of a dispute by judicial means is carried out by a court that adjudicates it according to the provisions of international law, on the other hand, the settlement of a conflict by political means is carried according the will of the conflicting parties, depending on the ability and position of each party of the conflict, Disputes that are suitable for judicial settlement are disputes that relate to legal matters, As for political disputes, they are not suitable for judicial settlement.

The settlement of disputes by judicial means is done by a body chosen by the conflicting parties which is called arbitration or by a specialized body to consider international disputes, countries agree to establish them, including the International Court of Justice and regional courts.

The study indicates that the International Court of Justice is one of the main entities of the United Nations, In light of the study results, it recommends the following: The necessity of all states settling their disputes peacefully with other countries, and a commitment not to resort to force, threat or use of force in their international relations.
