Arabic Abstract

تناولت هذه الدراسة موضوع مدى مسؤولية الإدارة على أساس الخطأ، من خلال فصلين و مجموعة من المباحث و المطالب الفصل الأول / ماهية الخطأ المرفقي في القانون والفقه الإسلامي المبحث الأول : تعريف الخطأ و أنواعه المبحث الثاني : صور الخطأ المرفقي و تقديره و الآثار المترتبة عليه ثم الفصل الثاني : تطبيق مسؤولية الإدارة المبحث الأول : مسؤولية الإدارة القائمة بدون .

خطأ و المبحث الثاني : الاختصاص القضائي بنظر المنازعات، ثم الخاتمة و النتائج و التوصيات.

و من ابرز النتائج : 1- لا يمكن أن يكون القرار الإداري السليم أساشا للتعويض على أساس الخطأ، مالم يكن بالإمكان مساءلة الإدارة على أساس المخاطر، و تحمل التبعية في الحالات التي حددها القانون صراحة أو قررها الاجتهاد.

2- الآثار المترتبة على الخطأ المرفقي و الخطأ الشخصي فهي حق المضرور في اختيار الجهة التي يطالبها بالتعويض، و عدم جواز الجمع بين التعويضين.

و قد أوصت الدراسة بعدم تعميم مسؤولية الدولة عن أعمال السلطتين التشريعية والقضائية ؛ إذ ترد على هذا المبدأ الاستثناءات التشريعية و القضائية، كما لا بد للقضاء من وضع ضوابط للحد من آثاره المطلقة المتنافية مع مبدأ العدالة.

English Abstract

This present study aimed to know the Extent of Administration Responsibility.

.

This study addressed the topic of the extent of responsibility of the administration on the basis of error, through two chapters and a set of investigations and demands, Chapter One / What is the Attachment Mistake in Law and Islamic Jurisprudence? The first topic: definition of error and its types.

The second topic: images of the elbows error, its estimation and its effects.

Then the second chapter: application of management responsibility, the first topic: criteria for distinguishing between personal error and elbow error.

And the second topic: the position of the judiciary from the criteria for distinguishing between personal error and elbows , Then the conclusion, findings and recommendations.

Among the most prominent results: 1.

A proper administrative decision cannot be the basis for compensation on the basis of error, unless management can be held accountable on the basis of risk, and the dependency is borne in cases explicitly defined by law or due diligence.

2.

The effects of the elbow and personal error are: the injured party's right to choose the party claiming compensation, and the inadmissibility of combining the two compensation.

The study recommended not to generalize the state’s responsibility for the actions of the legislative and judicial branches, as legislative and judicial exceptions respond to this principle, and the judiciary must put in place controls to limit its absolute effects incompatible with the principle of justice.
