Arabic Abstract

تناولت هذه الدراسة موضوع دور الوساطة الجزائية في حل منازعات الاحداث، باعتبارها صورة من صور العدالة الاصلاحية كنهج جديد في التعامل مع قضايا الأحداث واستخدم المشرع في قانون .

الأحداث رقم 32 لسنة 2014 مصطلح التسوية باعتبارها وسيلة جديدة لحل النزاعات و اتجاه مكمل للعدالة الجزائية مما يستلزم وجود دراسة علمية تتناول بيان المصلحة الفضلى للحدث، ومفهوم الوساطة الجزائية ودورها في تسوية منازعات الاحداث خارج نظام العدالة الجزائي التقليدي وسماتها وطبيعتها واثارها والسند التشريعي لها في القانون الاردني و المواثيق و المعاهدات الدولية، و كذلك تسليط الضوء على شروط وإجراءات نظام التسوية مع بيان الآثار القانونية المترتبة على نظام التسوية، ثم بيان العيوب و المزايا الحاصلة من هذا النظام.

كما وخلصت هذه الدراسة إلى مجموعة من النتائج والتوصيات ومن اهمها أن عملية التسوية تؤدي إلى أبعاد الحدث قدر الإمكان عن اجراءات التقاضي أمام المحاكم و من أهم التوصيات ضرورة اخضاع عملية التسوية إلى الرقابة القضائية و ذلك من خلال النص على ذلك في قانون الأحداث الأردني رقم 32 لسنة 2014م .

English Abstract

This study examined the topic of the role of criminal mediation in solving juveniles disputes, as a form of restorative justice as a new approach in dealing with juveniles cases as the Jordanian legislator developed the idea of settling disputes in juvenile crime and the legislator used in the Juvenile Law No.

32 of 2014 the term settlement as a new method To resolve disputes and an integral direction of criminal justice, where the juvenile was excluded from litigation before the courts in order to take into account the best interest of the juvenile, as the concept of dispute settlement, its characteristics, nature and legislative basis for it were outlined in Jordanian law, as well as highlighting conditions and procedures The settlement system with a statement of the legal implications of the settlement system, then the defects and advantages that arise from this system.

There is no doubt that this development in the treatment of the event came as a result of the modern view of the event as a victim and not my offender, and that rules must be applied to protect it, where the event predominates haste and lack of experience And the lack of management and its ability to distinguish between what violates the law and what does not violate the law, which was confirmed by international agreements, covenants and treaties, and to achieve the best interest of the event that the Jordanian legislator explicitly stipulated recently appeared what is called criminal mediation to protect delinquent juveniles that are based on Juveniles convicted or accused of crimes outside the traditional criminal justice system and the widespread use of alternative measures that are not free to liberty.

This study also concluded a set of results and recommendations.

The most prominent of these results is that the settlement process leads to as far as possible the juveniles away from litigation before the courts and from the results also the absence of judicial oversight from the settlement procedures before the juvenile police and from the recommendations that the settlement process should be subject to judicial oversight, from During the stipulation of this in the Jordanian Juvenile Law No.

32 of 2014 AD, as well as among the recommendations to appoint legal professionals in the Juvenile Police Department.
