Arabic Abstract

تناولت هذه الدراسة أحكام المسؤولية الجنائية للأفراد حسب النظام الأساسي للمحكمة الجنائية الدولية بالاضافة إلى مسؤولية قادة الإحتلال الإسرائيلي عن جرائمهم المرتكبة بحق الشعب الفلسطيني لإن الحد من الجريمة و معاقبة مرتكبيها يشكل الهدف الأول للمجتمع الدولي و هو ما يجسد هدف الدراسة، و تكمن أهمية الدراسة في قيام المسؤولية الجنائية للأفراد أمام المحاكمالجنائية الدولية دون الأخذ بصفاتهم القيادية أو الرسمية أو الدبلوماسية.

و تظهر مشكلة الدراسة في كيفية ارساء قواعد المسؤولية الجنائية للأفراد في القانون الدولي بالإضافة إلى مسئولية قادة الإحتلال الإسرائيلي عن جرائمهم بحق الشعب الفلسطيني كودهم أفراد، و لقد خلصت هذه الدراسة إلى مجموعة من النتائج كان اهمها أن فكرة المسؤولية الجنائية الدولية للأفراد هي فكرة حديثة النشأة أدت إلى إنقسام الفقهاء بين مؤيد ومعارض و لكن في نهاية المطاف تم القول بإسداد المسؤولية الجنائية للأفراد و هذا ما رسخه النظام الاساسي للمحكمة الجنائية الدولية بالإضافة إلى ثبوت إنتهاكات الإحتلال الإسرائيلي في الأراضي الفلسطينية من قبل الأمم المتحدة، أوصت الدراسة بإدراج عقوبة الأعدام على قائمه أحكامها و الابتعاد عن السلطة التقديرية في إصدار الأحكام على مرتكبي الجرائم الدولية بالإضافة إلى توصية النائب العام بمباشرة إجراء ات التحقيق بالقضايا المعروضة فيما يتعلق بالإنتهاكات الإسرائيلية على الأراضي الفلسطينية بشتى أنواعها، وقد قسم الباحث هذه الدراسة إلى فصلين على النحو التالي : الفصل الأول وتداول ماهية المسؤولية الجنائية الدولية للأفراد من حيث طبيعته المسؤولية الجدائية للأفراد و مفهومها و محلها و عوامل إنتفائها و من ثم التطور التاريخي للمسؤولية الجنائية الدولية للأفراد و من ثم المسؤولية الجنائية الدولية وفقا للقانون الدولي الإنساني.

أما الفصل الثاني فقد تحدث الباحث فيه عن مسؤولية قادة الإحتلال الإسرائيلي عن جرائمهم بحق الشعب الفلسطيني من حيث مسؤولية القادة الإسرائيليين عن تلك الجرائم و عن صور الجرائم المرتكبة بحق الشعب الفلسطيني و من ثم تم التطرق إلى آليات محاكمة أولائك القادة عن تلك الجرائم المرتكبة بحق الشعب الفلسطيني

English Abstract

This study examined the provisions of criminal responsibility of individuals according to the statute of the International Criminal Court in addition to the responsibility of the Israeli occupation leaders for their crimes against the Palestinian people because reducing crime and punishing the perpetrators constitutes the primary goal of the international community, which embodies the goal of the study, and the importance of the study lies in the establishment of criminal responsibility for individuals Before the international criminal courts without regard for their leadership, official or diplomatic qualities.

The problem of the study appears in how to establish the rules of criminal responsibility of individuals in international law in addition to the responsibility of the Israeli occupation leaders for their crimes against the Palestinian people as individuals, and this study concluded a set of results, the most important of which was that the idea of international criminal responsibility for individuals is a newly emerging idea that led to division The jurists are between supporters and opponents, but in the end it was said that the criminal responsibility of individuals has been assigned, and this is what was established by the statute of the International Criminal Court in addition to proving violations of the Israeli occupation in the Palestinian territories by the United Nations, The study recommended the inclusion of the death penalty on its list of judgments and avoiding the discretionary authority in issuing judgments on perpetrators of international crimes in addition to the recommendation of the Attorney General to initiate investigation procedures for the cases presented with regard to Israeli violations in the Palestinian territories of all kinds, and the researcher divided this study into two chapters as follows: The first chapter deals with the nature of the international criminal responsibility of individuals in terms of its nature, the concept of criminal responsibility of individuals, its concept and its solution, and the factors of its disappearance, and then the historical development of international criminal responsibility for individuals and then international criminal responsibility in accordance with international humanitarian law.

As for the second chapter, the researcher talked about the responsibility of the Israeli occupation leaders for their crimes against the Palestinian people in terms of the responsibility of the Israeli leaders for those crimes and about pictures of crimes committed against the Palestinian people.

Then, the mechanisms for trying those leaders for those crimes committed against the Palestinian people were discussed.
