Arabic Abstract

تناولت هذه الدراسة موضوعاً هاماً بتناولها مبدأ هامــاً مــن المـواضـيـع الدستورية المعاصرة و هو مبدأ المواطنة في الدستور الأردني أصبح مبدأ المواطنة من الركائز الأساسية في البناء الدستوري و السياسي في الأردن و في أي دولة حديثة و تتجلى أهم تطبيقاته في مؤسسات الدولة و أجهزتها، مما يعمل على توطين أركان الدولة، بما يحقق متطلبات التنمية في شتى صورها، حيث أن ضـمـان هـذا المبدأ ضمن الدستور يعطي المواطن الشعور بالأمن و الانتماء للوطن، و بذلك تتكافأ حقوق و واجبات المواطنة .

و بناء على ما سبق توصلت الدراسة إلى مجموعة من النتائج كان أهمها أن الدستور الأردني بأغلب نصوصه جاء ليقرر و يرسخ مبدأ المواطنة الديمقراطية، و يقرر حقوق المواطن الأردني و جعل الأردن دولة مواطنة ديمقراطية تراعى فيها الحقوق و الحريات الفردية و سيادة القانون و المشاركة الفعلية بين جميع الفئات في المجتمع الأردني، كما أوصت الدراسة أن يتم تطبيق القوانين التي تحد من الحريات و الحقوق للمواطنين في أضيق الحدود.

English Abstract

This study dealt with an important topic by addressing an important principle of contemporary constitutional topics, which is the principle of citizenship in the Jordanian Constitution, the principle of citizenship has become one of the main pillars in the constitutional and political construction in Jordan and in any modern state, and its most important applications are reflected in the institutions of the state and its organs, which works to strengthen the pillars of the state, in order to achieve the requirements of development in all its forms, as ensuring this principle within the Constitution gives the citizen a sense of security and belonging to the homeland, thus rewarding the rights of and citizenship duties.

Based on the above the study reached a set of results, the most important of which was that the Jordanian Constitution in most of its texts came to decide and establish the principle of democratic citizenship, and decide the rights of Jordanian citizen and make Jordan a democratic citizen state that respects the Individuals rights and freedoms, the rule of law and active participation among all groups in Jordanian society, as recommended by the study, Laws limiting freedoms and rights For the citizens should be applied in the narrowest Border.
