The mother may be the reason for obtaining the nationality later, as it is a key factor in giving birth to the newborn, and despite the fact that it is fixed and legislated and that the nationality acquired requires the submission of a request and consent of the competent authorities, but the legislation differed in granting this nationality through the mother in terms of Its substantive and formal conditions according to the principle of the freedom of the state to regulate its nationality and the specificity of the legislative philosophy of every legislator, some of which may be subject to criticism of the specialists in terms of contradiction of some of its provisions or ambiguity.

What we want is to try to urge the Iraqi legislator to take the provisions of both the Egyptian and French legislators of positive provisions in the subject of the study as well as the weighting of the jurisprudential views and his proposals on the evaluation of the existing legislative course
