The question arises : Is it permissible for a state to apply its national laws to all legal relations, whether national or foreign? This is not possible because international life is no longer confined to relations between countries.

Rather, it involves another category of relations : the special international relations between the members of these different countries, which requires that each State should abrogate the absolute territorial basis in the application of its laws and allow Its courts to apply the laws of other States to determine the law applicable to a foreign element, and that failure to establish substantive rules to regulate the relationship with the foreign element would harm their own interests and common interests.
