The recent era in the field of constitutional law has witnessed a significant leap in the field of human rights, as a new range of rights has emerged, namely the specialized jurisprudence on third-party rights based on cooperation between individuals and state institutions The most prominent of these rights is the right to the safety of the environment, which has been divided into several sections, the most important of which is the human right to live in a sound environment free from pollution and poisonous gases.

This right has become the subject of attention by the authors of national constitutions.

This interest was manifested by enshrining it in the constitutional document, Restrictions and controls on the public authorities in the state to regulate, and the reason for attention to the seriousness resulting from neglect and lack of care to maintain the same as other rights.

The constitutional trend in the "recognition of the right to the safety of the air environment" also strengthened the judicial decisions issued by the judiciary as the body that supervises the protection of human rights from the abuse of persons and public bodies, and the need for special legislation to regulate it.
